1. Terms of Use
Terms of Use (”Terms”) govern your use of the Restore by Swipestorm application (”Restore by Swipestorm”. ”Restore” or “Application”) operated by Swipestorm LLC (”Swipestorm”, “us”, or “we”). By accessing and using Restore by Swipestorm, you acknowledge that you have read, understood, and agree to be bound by these Terms and the Privacy Policy. If you do not accept these Terms and the Privacy Policy, you are not authorized to use the Application. We may modify these Terms and the Privacy Policy at any time and such modification will be effective upon posting to the Application.

3. Subscriptions
Subscription Period
Certain parts of the Application are accessible only with a paid Subscription (”Subscription”). Subscriptions are billed in advance on a recurring basis according to the frequency (daily, weekly, monthly, annually, etc.) selected when you purchase the Subscription. Unless canceled by you or by Swipestorm, your Subscription will automatically renew at the end of each billing period under the same terms.
Subscription Cancellations
You may cancel your Subscription renewal at any time through your Account settings or by contacting Swipestorm directly. Please note that canceling your Subscription will not result in a refund for fees already paid for the current billing period. You will retain access to the Application until the end of your current Subscription period.
Billing
You are required to provide accurate and complete billing information, including your full name, address, state, zip code, telephone number, and a valid payment method. If automatic billing fails for any reason, Swipestorm will issue an electronic invoice with instructions for manual payment. This payment must be completed by the specified due date on the invoice to maintain uninterrupted access to the Application.
Fee Changes
Swipestorm reserves the right to modify Subscription fees at any time. Any changes to the Subscription fee will take effect at the end of the current billing period. You will be notified in advance of any fee changes, giving you the opportunity to cancel your Subscription before the new fees become effective. Continued use of the Application after the fee change indicates your acceptance of the revised Subscription fee.
Refunds
Except as required by law, Subscription fees are non-refundable. Refund requests may be considered on a case-by-case basis and may be granted at the sole discretion of Swipestorm.
4. Intellectual Property
Restore by Swipestorm is owned and operated by Swipestorm. The visual interfaces, graphics, design, compilation, information, computer code (including source code or object code), products, software, services, and all other elements of the Application provided by Swipestorm are protected by the United States copyright, trade dress, patent, and trademark laws, international conventions, and all other relevant intellectual property and proprietary rights, and applicable laws. Except for any content that is provided and owned by Users, all materials contained on the Application are the property of Swipestorm or its subsidiaries or affiliated companies and/or third-party licensors. All trademarks, service marks, and trade names are proprietary to Swipestorm or its affiliates and/or third-party licensors. Except as expressly authorized by Swipestorm, you agree not to sell, license, distribute, copy, modify, publicly perform or display, transmit, publish, edit, adapt, create derivative works from, or otherwise make unauthorized use of the materials. Swipestorm reserves all rights not expressly granted in the Terms.
5. Limitation of Liability
In no event shall Swipestorm, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Application; (ii) any conduct or content of any third party on the Application; (iii) any content obtained from the Application; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
6. Representations and Warranties
Your use of the Application is at your sole risk. The Application is provided on an “AS IS” and “AS AVAILABLE” basis. The Application is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, accuracy, fitness for a particular purpose, non-infringement, or course of performance.
7. Updates to these Terms
At times it may be necessary for us to make changes to the Terms such as due to changes in the services we offer, Apple's policies and procedures, and/or the applicable laws of the United States. We reserve the right to update or modify the Terms at any time without prior notice. Please review the Terms periodically. The Terms were last updated on the date indicated below. Any changes to the Terms will become effective immediately. As set forth above, your continued use of the Application after any changes or revisions to the Terms shall indicate your acceptance and agreement with such revised Terms.
8. Governing Law
Any claim relating to Swipestorm LLC's content shall be governed by the laws of the State of Connecticut without regard to its conflict of law provisions.
